On March 18, 2026, the New South Wales (NSW) government gazetted a voluntary Code of Practice for the use of Facial Recognition in Hotels and Clubs.
This initiative aims to provide guidance on the appropriate deployment of facial recognition technology (FRT) to identify excluded patrons in venues with gaming machines, while emphasizing data security and privacy protection standards.

The Code applies to venues currently utilizing FRT and those planning to implement it in the future. Although adherence to the Code is voluntary, establishments are encouraged to follow its guidelines, which outline best practices for FRT usage. This development represents an interim step towards the NSW Government's commitment to mandatory facial recognition to support the Statewide Exclusion Register.
